Hate, Fear and Ignorance
I had the displeasure of listening to a “free” podcast about what I thought was “consumer protection”, which ended up being a “Muslim hate fest”.  With crude jokes etc… so here are a few thoughts for the person that made those comments.
First, you pouring your hate and fear on to the radio waves is unnecessary.  What this woman said is not new, not intelligent, not funny,   and basically of no value to anybody that was listening.  We get enough hate filled speech just by watching the news, or a political debate. By watching any of that, you can see we have much bigger problems on our hands.
My words of advice are stick to what you know. This was supposed to be about debt collection and the FCRA, but for some reason, this woman thinks her world views are of interest.  I find it funny how hate can make you miss some of the most helpful things in your field.  Her hatred for the color of Obama’s skin, blinds this women to the most useful tool Obama put into place.  Namely, the CFPB.  I find it funny that these people who are to be “debt specialist” can’t see or use the very things President Obama laid at their finger tips.  They would rather spend years in a court room, arguing over a debt that is clearly not theirs, wrapped up and feeding into the same legal system that oppresses them.  That is just absolute stupidity.  The even worse part, they teach others to do the same, only to tell them at the end, they should drop it.  It never occurred to this woman and this group, that maybe, just maybe, they should not be playing in a system that is unnatural and not meant for them….maybe, just maybe, there is a better way….
Ok, I strayed for a moment…the Muslim cartoons… one of the cartoons she described had to do with sheep.  Here’s a tip for her white privileged hate speech.  You might want to check your ancestry, I am sure you have men somewhere in it, and sex with sheep is not a practice only relegated to the Muslim culture. While we are on the subject of “white privilege” and “culture”, anybody that knows the history of this country, knows we are all immigrants.  The Europeans were not first, sorry to burst your bubble.  It is a known fact that this country was built on the backs of very diverse cultures.
This woman is a Trump lover, and I am positive she would be in favor of a wall, but here’s the deal.  It’s called “creative destruction”, tearing down the old and antiquated to replace it with something new and functional. It’s time to tear down this “rigged” system and replace it with something new and functional.  Only she does not see the new system.  Maybe that new system is for us to quit playing into the hands of hate mongers, policing for profit, an unnatural legal system, “foreign” state courts, a criminal financial system, war on immigrants, and walls etc… as I said, we have much bigger problems in our backyard that need to be solved.  These problems in our own backyard have been festering while we were INVADING, AND STEALING FROM THE MUSLIMS.  Always remember, they didn’t come here to mess with us, until after we went there to mess with them.
This woman made reference to jokes about Muslim’s, well here’s a tip for her.  YOU are on public radio, people know where you live, people know your name, and I am sure you know what happened in France at the Charlie Hebdo offices.  Just saying, again your hate filled speech may incite some violence that may be laid on your doorstep. This is the kind of ignorance and privileged attitude that begets that type of violence. This is the type of ignorance that got us to the place we presently occupy, hate filled division. It hasn’t been working for us, maybe we should try something different.
This woman was going dress up for Halloween as a basket of “deplorable’s”, here is some news, you don’t have to waste your money on a costume.  Again, we know she is a Trump supporter, the guy that has shown you exactly what White Privilege is, exactly what White Privilege has done, and she supports that system, because is it just as morally bankrupt as she is.  The worst part, she doesn’t even hear his message….the system you have been playing in, the one you believe in, is RIGGED…  This chick really needs to get a clue.
Lastly, this woman who is so involved with consumer protection actually stated on the air, that she does not know the numbers that correspond with the FDCPA violations.  Well here is my last tip for her… They are LETTERS, and the 28 pages, does not even use all of the letters, it stops at P. P for Pea brain, Privilege, Phony, Psycho, Parasite, Paranoia, Parrot, Puppet, Perverted, the list goes on and I am sure you get the picture. Yet she is the FCRA guru, and only know 1681 s(2)(b), S for Sadly, she got 2 B quitting early, there are no more callers….Somebody already ripped off the mask, and they see exactly “What Lies” in her lack of knowledge.

Wells Fargo, The Deeper Issue

Along with the all of the lawsuits, and monetary penalties, and the loss of business from the States of California, Illinois, and now Massachusetts. On top of all of that I the $99 billion in deposits, $4 billion in revenue, and 30% of their customer base.  On top of a the Labor Department looking into the banks human resource dept. and a possible criminal investigation. This has gone far beyond damage control.  All of these investigations are sure to expose more dirt.
This situation has proven that the people should be frustrated with the banks, and the entire financial system as a whole.  The complete disregard Wells showed for it’s own customers is indicative of a much deeper problem.  Banks have been caught fixing the housing crisis, stealing homes with ILLEGAL foreclosure practices, rate manipulation, insider trading, etc… all they paid were fines.
Wells is about to be the example of what happens when banks ignore rules and regulations, and falsely believe they are above the law.  That they can just pay a fine and continue with business as usual.  This to me is a clear message that the banks must change their ways or in within the span of two months, they can be dismantled.  Meaning the consumers are going to put up with so much.
Within two months, the CFPB has completely dismantled and brought the bank to it’s knees by taking away the thing it loves above all else, PROFIT.  It was not until the profits were threatened that the bank really did something about it’s internal executive management problem.  Within two months, one of the oldest and largest banks has been put on the ropes.
The genius of this scandal is that it is understandable to the average consumer.  Not everybody understands insider trading, derivatives, or illegal foreclosure, but everybody understands “fraudulent accounts”.  That is clear, recognizable, and understandable.  Blaming low level employees is also understandable.
This scandal placed the business of banking on front street for all to see.  Now, the Comptroller of Currency has sent a letter to all of the large banks, letting them know that they too are about to be investigated for their sales practices.  Mark my words, this is only the beginning….

Whistleblower or Insider?

 

Again, here is the issue with all other “consumer education” sites out there and the information that comes with them.  Simply, consider the source, investigate, and always use critically thinking.

At CIB we sent out a test audio for students, and asked for you to tell us what you think.  Most of the responses were right on the money, some missed the mark a little, but maybe this will assist all of you.  I have to admit, I only made it through part of the audio before I got too angry to listen any further.

When CIB asks you to think critically, that means vet the information.  So I looked up the Linda Almonte case and  SEC letter.  Well, I found some surprising things.   Almonte worked for NCO Group (now Transworld Systems Inc. or TSI)  before being employed by  Chase.   Well it seems there is a relationship between Chase and NCO (TSI).  I am well acquainted with TSI and I thank her for more ammo in which to further destroy TSI.   The fact remains, Almonte worked for a debt collector as a mid-level executive.

The list of Chase “crimes” are as follows:

  1. Chase sold to third party debt buyers hundreds of million of dollars worth of credit card accounts…when in fact Chase Bank executives knew that many of those accounts had incorrect and overstated balances.
  2. Chase Bank executives routinely destroyed information and communications from consumers rather than incorporate that information into the consumer’s credit file, including bankruptcy notices, powers of attorney, notice of cancellation of auto-pay, proof of payments and letters from debt settlement companies.
  3. Chase Bank executives mass-executed thousands of affidavits in support of Chase Bank collection efforts and those Chase Bank executives did not have personal knowledge of the facts set forth in the affidavits.
  4. When senior Chase Bank executives were made aware of these systemic problems, senior Chase Bank executives–rather than remedy the problems–immediately fired the whistleblower and attempted to cover up these problems.

So after listening to the audio, I had to wonder why Almonte would “throw out the FDCPA”?  Why would she trash the CFPB?  Were her claims about the CFPB true?  Oh, and the Clinton foundation?  So let’s start with the CFPB (Consumer Financial Protection Bureau).

The CFPB is not there to enforce your protections for you, they are there to show you how to enforce them yourselves, via  YOUR PRIVATE RIGHT OF ACTION, the CFPB does not need to hire attorneys, they are attorneys. They are your record keeper, they cannot intervene on your behalf, but they do have a Amicus Brief Program.  I suggest you check it out, the people on this audio did not.  As far as complaints being answered by “outside attorneys”, I know the allegation is BS… I have filed complaints with the CFPB and on each occasion, the response was from the slimy bottom feeding debt collector.  Trust me, I recognize their special kind of inelegant writing style. As for funding The Clinton Foundation, again, nope, not going to fly.  The Civil Penalty Fund is under the CFPB control, not Congress, or any other entity.  It is set up to pay victims, and fund Financial Education Programs, as well as fund Enforcement Actions, etc… against violators.  See the Dodd-Frank Act, these people failed to read it….

Now for the meat and potatoes.  As I said, Almonte worked for and as a debt collector NCO (TSI).  Here’s the deal she is trying to sell you.  A class action suit under RICO, Sarbanes-Oxley Act and Title 18.  Seriously?  When have you ever heard of a RICO case getting though on a bank?  When did anybody get more than $100.00 on a class action?  Here is the big question, why would a consumer hire an attorney?  You as a consumer have Article III power, more power than a judge, congress, and the CFPB combined.

Now, why would an “ex-debt collector” be steering you away form the FDCPA?  With all of her insider info, Almonte should be pushing consumers toward the FDCPA.  Instead, she has a “go fund me” account for a class action law suit.  She didn’t get paid as a Whistleblower for a reason, maybe because the very things she “blew the whistle on” are wide spread, illegal practices debt collectors have been engaged in for a long time.  It’s not news.

We know banks, credit card companies, hospitals, doctors, dentist, etc.. all sell “debt” to debt buyers.  The information received by debt buyers is inaccurate to say the least, and this inaccurate information is used to intimidate, threaten, and oppress you.  Unless you know consumer protection, the FDCPA, so who exactly is Almonte working for?

If you have been listening to CIB, you know debt collector affidavits are crap, and you know how to destroy them.  You know selling your private, personal information is illegal, or Identity Theft. You know debt collectors must have your consent to talk to you.  You know how to ask for and exactly what  “verification” is. You know how to make them go away, and how to make them pay.   If you don’t, maybe you should be listening to CIB…..

Deutsche Bank $14 Billion???

I know it sounds nice to think Deutsche bank will have to pay $14 billon, but that is just what the DOJ is requesting, not what the bank will have to pay.  Both sides will negotiate a settlement.  At the moment, Deutsche could not pay that kind of fine anyway.

Deutsche only has reserves ranging from $5.5 billion to $7.2 billion by estimates.  So the $14 billion would be reaching. Citi Bank was hit for $12 billion and ended up paying $7 billion after negotiations.  So Deutsche is at the refusal stage, and will enter negotiations soon to find an actual settlement number.

I find the number $14 billion curious. It’s the same amount the European Union is asking Apple to pay in back taxes….  Maybe a coincidence, but my alien self says no way!!!  It is no coincidence that Deutsche is a German bank,  Germany is one of the main decision makers for the EU.  Could this be a veiled message from the U.S.?  You tax our corporations, we tax yours? Sounds like it to me.

Germany cannot allow Deutsche to fail, the Global Financial System cannot allow Deutsche to fail.  So would Germany bailout Deutsche?  Absolutely!  They would have no choice, Deutsche failing would be 100 times worse than Lehman Brothers.  Eight years later and we are still facing the possibility of, and  the same reason for the 2008 meltdown, and it’s only grown much larger.

My guess, Apple’s fine will be reduced, and Deutsche will settle for much less.  In this game of global financial chicken, it depends on who blinks first, the US or EU…..

The Power of Your Mind

Too many of us rely on logic and reason.  Yes, they are great things.  We tend to absorb information, categorize information, but rarely use the information.  Most of the information is really of no use, it just takes up space, keeps thoughts racing around in our heads that have no value.  Or worse, negative value, meaning our minds use them against us to create fear and stress. Or even worse is ingesting false information. We take that information as truth, even though it sounds good, plausible, but in the end it’s really a soundbite of somebody’s opinion.

We want magic potions, easy answers, a pill, a cure, or somebody to lead us because we incapable of leading ourselves.  We have lost the capacity to think for ourselves, or more importantly trust our intuition.

We all have that “gut feeling” when making decisions.  That tells you something is too good to be true, to easy, to whatever.  We fail at every turn to listen to ourselves.  Our own God voice inside us.  Why is we are so ready to follow somebody, and ignore or dismiss our own God voice?  We have become so programed to follow  politicians, religious leaders, news anchors, etc… instead of relying on ourselves and form our own opinion, our knowledge, our inner God Voice.

I often wonder just what is wrong with us?  Why would we follow somebody because they have a title?  Or obey because they were a suit, a robe, or went to the best school.  Does their knowledge supersede yours?  Does the way they dress, or speak, or their “position” denote some sort of power over us?  The answer is no.

We have become so prone to filling our lives with chatter and other people’s opinions we have shut our own out.  We don’t even bother to listen to it anymore.  Our very own God voice is lost or it has become such a strange voice we sometimes hear but discount.  The very voice that is the key to your existence is shunned. The very voice that is the basis of your natural creation and the voice that enables you to create is told to shut up.

Some might call it logic, or common sense.  Mystic’s call it the inner self or the actual Self. It is within all of us, we just have to block out the noise, chatter, and information.  The Self is the essence of what and who we are.  Ever notice how  you fill your day with noise.  Turn on the TV first thing after getting out of bed, or have it playing the entire night while you were sleeping.  Get in the car, the radio is on before you put the car in drive.  Why do we avoid being alone with our thoughts?  Why do not want to hear the voice of reason that dwells within us?

Sometimes we don’t like what it says, because we simply don’t like ourselves.  We don’t want to go inside of ourselves because we may not like what we find or is the fact that there is no clear cut process to finding our Self.  No step by step guide book.  We will spend hundreds of dollars on self help books, and read every page, but we won’t simply turn down the radio long enough to establish a relationship with our inner Self.

The key to happiness cannot be found in another person or a thing.  It is found within you, it dwells within you. You just have to uncover it.  Dust if off.  You will find the power to be happy, the answers to questions, the path to follow, the Everything is within.

This is why and how meditation works.  Your ego mind or monkey mind is always going to think. Thinking is all it does, 24-7, round and round, like a hamster on a wheel.  So if you want to talk to your Self, you have give the monkey something to do, like you give a dog a bone, or a child a toy.  Monkey has one job in mediation, to think about your breathing.  That’s it, no multi tasking, no singing, no thoughts about the future or the past.  It is presently only to think about breathing. Trust me, this will be very hard for you at first, but it gets easier.

With the ego distracted you can be with your Self.  This is the power of meditation.  It gives you peace of mind.  It is soothing, calming, and energizing all at the same time.  Generally when done you will feel refreshed, and most “issues” or “problems” will had sorted themselves out, or maybe you they were never there to begin with, they were created by the monkey.  Over thinking creates the fear, doubt, and stress we Think we have everyday. Over thinking creates the blocks to real power, control, and knowing.  The best thing you can do with a problem is to leave it alone for a moment.  Trust me, it will be still be there  when you get back.  The monkey won’t allow somebody to steal the thoughts or problems, they will still be there, but you will be able to see them clearly for what they are, or are not.

If you are experiencing a block, or have a decision to make, nobody is more equipped or able to answer better than yourself.  At the very least you will be able to make a decision or chart your own course with real input from the only source that matters.  YOURSELF…..

Wells Fargo Case Explained…

So what exactly happened with Wells Fargo?  What did they do that was so wrong?  Well, it started with the banks sales culture.  I have 15 years of banking experience,  I was one of those “mid-level” managers that pushed those mandated sales goals.

It starts with CEO’s and Senior Management setting goals for the bank as a whole.  Most banks are happy with a 3 to 4 product relationship with any given household.  Wells wanted an 8 product relationship with each household, even if the household didn’t need all the products and services offered.  That means, for every household, Wells employees need to get customers to add on to the relationship by opening other accounts, credit cards, check cards, etc…get customers to use all of the bank services.  The goal of this is to build a relationship that is too tedious to break.  The more you have to move, close, change etc… makes customers more willing to stay even if you provide crappy service.  It’s just to time consuming to move to another bank, and untangle that relationship.

I know that sounds simple, but it is a well used business retention philosophy. It works incredibly well with banking.   Moving accounts involves not only moving the money in the account, but getting new debt cards, changing over direct deposits, or if you pay bills automatically from that account, those have to be switched over, and this could take at least two weeks to a month.  I can’t be without my debt card for a week. Each account outside the bank, but tied to the bank, must be switched over individually, which is very time consuming and tedious. So the answer is to live between banks for the time period of switching but most people will just put up with the crappy service.

So Wells Fargo put these large relationship quotas on low level employees, and made it a part of actually keeping their jobs.  Yes, your sales quotas count, and if you don’t meet this expectation, you are gone, no more job.  So when faced with the possibility of being unemployed, 5300 employees choose to scam the system.  What would you do if faced with impossible sales goals, the possibility of losing your job, and no other job prospects to go to?  I am not saying what they did was right, but still, those at the top have to take some responsibility for the corporate culture they created.

This scam, right or wrong, made a lot of money for Wells’ CEO’s, and investors.  In the years the scam was going on, Wells stock price went up $30.00 per share.  In raw numbers or actual money, for the CEO John Stumph alone that was a $200 million dollar personal gain.

Carrie Toldstadt, the person in charge of this culture, as Head of Community Banking, retired in July 2016 with a $128 million dollar package.  Funny her retirement came about just two months before the CFPB investigation was released.  Meaning, the investigation, the “wrong-doing” was already known to the CEO and Senior Management.  Her retirement was to shelter her from the fallout.

When Stumph appeared before the Senate Banking Committee, we leaned that Toldstadt is still working for Wells, at least until the end of this year, and she is up for a “sales award”.  Truly, you can’t make this shit up! The “woman” directly responsible for creating a culture that not only forced employees to scam consumers, but it was done on her watch.  I want to work for Wells compliance department….I could watch soaps all day while the employees run amok…. sounds like a great job, especially since I won’t get fired to for not doing my job, the $12 dollar an hour grunts will take all the blame…..

So 5300 employees have lost their job, and Carrie Toldstadt not only gets a monetary reward of about $128 million, and gets to freelance till the end of the year, but also a big pat on the back and recognition for the fucked up sales culture she created.  What a world!!!  On top of that.  Even with all of this information, Wells will not employ it’s “clawback” provision with Toldstadt.  Where they could withhold or take back some or all of the retirement package she received to pay the CFPB fine.  In essence, they are not only letting her off the hook, but compensating her for the scam.

As I mentioned the Wells Compliance Department.  If you don’t know what the Compliance department does, well the job title should tell you.  They are the department that makes sure Wells Fargo and all of it’s employees follow the law.  If a customer complains about illegal account openings, the compliance department would investigate the allegation.  They are the bank’s very own inside cops.  They would be the department making sure 5300 employees could not open millions of fraudulent accounts.

Most importantly, bank CEO’s only look at stock price, because that is the way they are compensated.  We keep waiting for somebody to fine the banks or hold somebody above mid-level management accountable.  Wells has proven again that this will not happen.  So maybe we, the consumers have to start holding them accountable.  Make it less profitable for them.

If their compensation is directly tied to stock prices and bank performance, start moving your accounts.  As I said, I know it’s a pain in the ass, but you and I are the only ones that can institute some justice. Bank CEO’s will continue shelter themselves and executives, while putting the shareholders and employees on the hook for the illegal acts, and the will be at risk until the consumer steps up.

The formula is simple.  We move our accounts because we no longer have confidence in the Wells Fargo’s ability to do honest business. The more consumers that leave, the further the stock price falls.  Investors pull out, and the bank closes or reverses course.  The way to hold people who believe they are immune from justice accountable, is to show them that they are not immune. There is only one way to stop greedy people, take away what they covet most, the incentive of money.

One day you, the consumer, will finally see your collective power. Your ability to change the system.  All you need to do is wake up.

Senator Elizabeth Warren, Who does she WORK for?

Some are trying to decide exactly whom Senator Warren speaks for.  Well, let me see, she has denounced Wall Street, Banks, Bank CEO’s, TPP, and that’s just for starters.  She has been on a mission to revamp the US financial system and helped create an agency to protect, inform, educate, and empower the CONSUMER with the CFPB (Consumer Financial Protection Bureau).

All the “people” out there that believe in a Political Party system should take notice of Senator Warren.  She is not afraid to call out her own party President Obama, nor other parties.  It seems every time she speaks, she calls out the hypocrisy of the entire system.  Yeah, Donald Trump does that, but she does it with facts, common sense, logic, and research.  She does not have to aim her anger at an easy cultural scapegoat. She takes aim at the exact issue, the elitist.  Does not matter if it is a multinational company, or bank CEO.  She too is fed up with the abuse of consumers in all facets, shapes and forms.  The rich keep getting richer off the backs of those living paycheck to paycheck  .

For example her questioning of Wells CEO John Stumph.  Warren made the comparison of a bank teller taking a handful of money, stealing, and would be prosecuted as a criminal.  While Stumph made over 200 million in Wells stock returns.  Yes, his personal stock.  Here’s the deal.  Wells head of Community Banking and CEO Stumph pushed low level employees to cross-sell bank products to deepen relationships. Employees unable to meet those quotas, opened fake accounts, in essence to save their $12.00 an hour job.  This pushed up stock prices year after year, making Wells appear to be doing “honest” business, when in fact, it was not.  In the end, Stumph made $200 mill, and 5300  low-level (consumers) employees lost their jobs.  Don’t worry!  The CEO’s and Senior Management are ok!  They are all still working on the next way to have their employees screw over the consumers.  Get it, the employees are on the hook, while again the CEO’s and management are immune.

I have watched Warren go after bank CEO’s  and now the DOJ, FBI, and TPP.  TPP and the hold these multinational corporations have on our “elected officials”.  She is not on the side of Apple and it’s $14 billion tax issue with the European Union.  How does a company that makes that much in profit only pay 1% in taxes?  I get it, our corporate taxes are truly high at 35%, but almost every large corporation only pays on average 14%.  The Consumer makes up that difference.  Social Security used to be paid by your employer, now it’s paid by you, the employee.  Heath care used to be paid by employers, now it’s paid by you, or you don’t have it and get TAXED for not having it.

In short, Senator Warren is simply not afraid to set things right.  She knows the consumer had not benefited in a long time.  She knows that if the abuse of the consumer is not stopped, this world will tilt towards chaos. Yes, I do mean chaos.  What happens when we are fed up as consumers?  We stop buying, or simply can’t buy.  That is already happening with our economy.  We stop, the world stops.  We stop creating, shopping, buying, and eventually stop paying.

It’s time we give Senator Warren the props she deserves.  It’s time we as consumers start taking being a Consumer seriously.  Senator Warren is trying to put the Consumer back on top.  The Consumers are the engine of the World.  Wake up and step into your power.

One-third of police officers discharged from duty get new police jobs in Wisconsin

I hope you watched the above with absolute disgust.  When you get fired or discharged from a job, your personnel file follows you to every job you have after it.  Every day you were late, how many sick days you used, and if you took your vacation.  Even though it is against the law, ex-employers do go into your “attitude”, your “trust-worthy-ness”, and dependability.  Human Resource Departments have a silent code to make sure they do not pass on problems to the next company or business.

Yet it seems if you are a “fired police officer” you would be “immune” from such scrutiny.  It reminds me of how the Catholic Church just passed around pedophile priests, instead of solving the problem. Just push one bad apple on to the next tree….

You and I are continually followed by our record of conduct.  We have police records, driving records, credit records, job records, school records, tax records, business records, etc… the list is never ending.  These records are used to evaluate us, and used against us everyday.  If you are speeding, your driving record shows you have been caught before, therefore you have chronic problem, and get another citation.  Your insurance goes up because now your a “danger” to yourself and others. See how one record leads to another, in the end it costs you more.  Poor credit translates to higher cost of debt, and higher insurance premiums. Your credit report may determine if you get a job or not.

I wanted to start a small business, a bakery, in my city.  The first thing I was told….You need to have a back round check.  When I asked why, I was told because I “would be working with the public”.  Well ok, by that logic, don’t police officers work with the public?  Just asking.  Here’s the deal, I saved myself about $600.00 in fees, plus a back round check that included finger printing, etc. by getting licensed in a smaller community not tied to the city I live in. I guess that’s what fired police officers do also.

I say this in light of Sandra Bland’s family settling for 1.9 million dollars.  Yes, it is a nice chunk of change, but the officer that arrested her, was simply just fired.  I would be inclined to believe that asshole is right now in the process of getting a job in a small community.  He will have a friend or a sympathetic “brother in blue” that will take him in and give him a job in law enforcement.  Meanwhile, the Bland Family must move on without Sandra.

Look, I get it.  My paper record truly says nothing about me, and I am willing to cut cops the same slack.  My problem, when you have shown you do not possess the aptitude, or capacity to do the job properly, do you deserve a second chance?  The lying, cover ups, falsification of reports etc… goes completely against the principals of the job.  How hypocritical of an police officer enforcing laws they break everyday. Holding us to a higher standard.

Maybe it’s time to start charging their insurance.  The way insurance  companies do to us when we have a lead foot.  Premiums go up because of the inability  to self govern driving habits.  Making claims against the insurance bonds of bad police officers would make them to expensive to insure.  Just like doctors and malpractice insurance.  They have to find another occupation because they can’t afford to be doctors. Instead of or in conjunction with taxing the city that employs these officers, we should start making it too expensive for them to be bad cops.  Just a thought….

Whistleblower or Insider?

Again, here is the issue with all other “consumer education” sites out there and the information that comes with them.  Simply, consider the source, investigate, and always use critically thinking.

At CIB we sent out a test audio for students, and asked for you to tell us what you think.  Most of the responses were right on the money, some missed the mark a little, but maybe this will assist all of you.  I have to admit, I only made it through part of the audio before I got too angry to listen any further.

When CIB asks you to think critically, that means vet the information.  So I looked up the Linda Almonte case and  SEC letter.  Well, I found some surprising things.   Almonte worked for NCO Group (now Transworld Systems Inc. or TSI)  before being employed by  Chase.   Well it seems there is a relationship between Chase and NCO (TSI).  I am well acquainted with TSI and I thank her for more ammo in which to further destroy TSI.   The fact remains, Almonte worked for a debt collector as a mid-level executive.

The list of Chase “crimes” are as follows:

  1. Chase sold to third party debt buyers hundreds of million of dollars worth of credit card accounts…when in fact Chase Bank executives knew that many of those accounts had incorrect and overstated balances.
  2. Chase Bank executives routinely destroyed information and communications from consumers rather than incorporate that information into the consumer’s credit file, including bankruptcy notices, powers of attorney, notice of cancellation of auto-pay, proof of payments and letters from debt settlement companies.
  3. Chase Bank executives mass-executed thousands of affidavits in support of Chase Bank collection efforts and those Chase Bank executives did not have personal knowledge of the facts set forth in the affidavits.
  4. When senior Chase Bank executives were made aware of these systemic problems, senior Chase Bank executives–rather than remedy the problems–immediately fired the whistleblower and attempted to cover up these problems.

So after listening to the audio, I had to wonder why Almonte would “throw out the FDCPA”?  Why would she trash the CFPB?  Were her claims about the CFPB true?  Oh, and the Clinton foundation?  So let’s start with the CFPB (Consumer Financial Protection Bureau).

The CFPB is not there to enforce your protections for you, they are there to show you how to enforce them yourselves, via  YOUR PRIVATE RIGHT OF ACTION, the CFPB does not need to hire attorneys, they are attorneys. They are your record keeper, they cannot intervene on your behalf, but they do have a Amicus Brief Program.  I suggest you check it out, the people on this audio did not.  As far as complaints being answered by “outside attorneys”, I know the allegation is BS… I have filed complaints with the CFPB and on each occasion, the response was from the slimy bottom feeding debt collector.  Trust me, I recognize their special kind of inelegant writing style. As for funding The Clinton Foundation, again, nope, not going to fly.  The Civil Penalty Fund is under the CFPB control, not Congress, or any other entity.  It is set up to pay victims, and fund Financial Education Programs, as well as fund Enforcement Actions, etc… against violators.  See the Dodd-Frank Act, these people failed to read it….

Now for the meat and potatoes.  As I said, Almonte worked for and as a debt collector NCO (TSI).  Here’s the deal she is trying to sell you.  A class action suit under RICO, Sarbanes-Oxley Act and Title 18.  Seriously?  When have you ever heard of a RICO case getting though on a bank?  When did anybody get more than $100.00 on a class action?  Here is the big question, why would a consumer hire an attorney?  You as a consumer have Article III power, more power than a judge, congress, and the CFPB combined.

Now, why would an “ex-debt collector” be steering you away form the FDCPA?  With all of her insider info, Almonte should be pushing consumers toward the FDCPA.  Instead, she has a “go fund me” account for a class action law suit.  She didn’t get paid as a Whistleblower for a reason, maybe because the very things she “blew the whistle on” are wide spread, illegal practices debt collectors have been engaged in for a long time.  It’s not news.

We know banks, credit card companies, hospitals, doctors, dentist, etc.. all sell “debt” to debt buyers.  The information received by debt buyers is inaccurate to say the least, and this inaccurate information is used to intimidate, threaten, and oppress you.  Unless you know consumer protection, the FDCPA, so who exactly is Almonte working for?

If you have been listening to CIB, you know debt collector affidavits are crap, and you know how to destroy them.  You know selling your private, personal information is illegal, or Identity Theft. You know debt collectors must have your consent to talk to you.  You know how to ask for and exactly what  “verification” is. You know how to make them go away, and how to make them pay.   If you don’t, maybe you should be listening to CIB…..

9-11 Fifteen Years Later

I was sitting here this morning in complete silence.  Thinking of the last 15 years and how we have changed, but then I had to ask myself, did we?  Did we really change?  That day is the day most people describe as the “Day that changed our Nation”.

For awhile, I believe we changed.  We were united for a few years.  We were much more accepting, giving, kind and in a sense, more loving toward each other. More likely to lend a hand, or a simple smile.  In the last 15 years, we have reverted back to what we were before.  If you don’t know what that is or was, take a look at the nightly news.

We failed to truly wake up.  It does not matter if you believe the government had a hand in it, or the act perpetrated by Muslim extremists. Real people died that day.  They were mothers, fathers, sisters and brothers, they were men and women. Everybody I have ever spoken to about 9-11 knows where they were when it happened.  They can tell you who they were with when they heard the news, what they were doing, etc.  For an event so ingrained in our memories, we have looked past the point, and failed to learn a lesson.    The absolute horror of that day should never be forgotten.  This is the day, our “Freedoms” were turned against us.

The Firefighters, Police, Port Authority, and all other first responders rushed in when all others were rushing out.  They went in to a burning building to save “civilians”. Not just the Polish white people, or the Afro- Americans, or the Latino Americans, but civilians.  They sacrificed their lives to save others.  Civilians they did not know, maybe some not worthy, but it was the duty they signed up for, the public  they swore an oath to protect, they sacrificed their lives in Honor.  It was the choice they made.

We continue to have an opinion about sports stars that don’t stand for the National Anthem, or flag burners, or protesters of any kind.  We have failed to see what came before us, again, those that sacrificed their lives for the freedoms we enjoy.  In many other countries, speaking your mind, or dissidence of any kind is worthy of execution. America is one of the few places on earth where we can vocalize our “opinions” and “beliefs” without fear of retribution. It is a choice every man and women is free to make.

In no way is America perfect, we have  far more problems than solutions.  With that said, we also have far more opportunity.  Opportunity to change things, opportunity to learn, opportunity to succeed, simply because others sacrificed we have an opportunity to choose.  With the playing of the National Anthem, we can choose to stand, or kneel in protest. We choose the oaths we take, and the oaths we break. We choose to hate, love, unite, or stay divided.  We choose to speak out or stay silent.  We choose to fight or forget. At the start of each new day, we choose to wake up, or stay asleep.
